What’s the Employment Equity Act?
Fed legislation: puts visible minorities, inds w/ disabilities, women, etc. on the same playing field in terms of employability as healthy, white males > ONLY an ind’s skills are considered
Why aren’t pharmacists entitled to overtime pay?
Because they’re “professional employees”, hence, under the law, they are not entitled to it (there’re other types of employees who don’t receive overtime pay)
What’s collective bargaining?
Continuous talks b/w the union and management to establish terms/conditions of employment (e.g. wages, hours, etc.)
What’re some negotiation tactics used by management?
Lockouts
Gov’t injunction
Strikebreakers (employing others in place of those who strike)
Battle for pub support
What’re some negotiation tactics used by unions?
Strikes Picketing Boycotts Sabotage (illegal) Work slowdowns
Why would there be restrictions on physicians going on strike?
Bc their work is absolutely essential for public safety, so striking would put a sig. portion of the public at risk
Purpose of grievance process?
They help to reduce conflicts by allowing union members to be able to make a formal complaint in response to management violating the terms of the contract
The dispute process:
Grievance > conciliation > mediation > arbitration
Diff b/w mediation and arbitration ( last two steps, respectively, of the dispute process)?
Mediation: 3rd party suggests ways to resolve conflict (non-binding)
Arbitration: 3rd party gives a binding decision on how the conflict will be resolved (binding)
