Labour law
Deals with 2 categories or relationships
- Union management
- Employee-union
Governed by provincial legislation (SK Employment Act) and federal (Canada Labour Code)
Under labour legislation, unions are the sole bargaining representative for the employee they represent
Labour Relations Board: forum for labour law issues rather than the courts
Employment Law
Deals w employer-employee relationships where there’s no union representation of employees or dealing w management employees
Governed by contract law principles and provincial and federal legislation
Implied terms in common law employment contract
- Obligation to mitigate after breach has occurred
- Employees duty of loyalty
- Employees duty of competence
- Employers duty, upon termination, to give adequate notice or severance in lieu of notice

Confidential info: industrial trade secrets, info learned on job
Non-disclosure of confidential info is often considered to be a FIDUCIARY obligation
APEGs code of ethics contains obligation to maintain confidentiality
Restrictive covenant
Employee agreement for specified time after employment to not work for competitor, in specified geographic area, or in a particular business
Independent contract or employee
Independent contract: don’t have rights to reasonable notice or compensation
Difference in control employer has on work, insurance, tax, liability, etc.
Human rights
Human rights legislation: deals with human rights complaints and prohibits harassment
Tribunals: are set up under legislation to deal with complaints
SK Human Rights Code: prohibits discrimination on basis of religion, marital, sex, age, disability
