What are the two possible exam questions on barristers?
-Describe the work of a barrister
-Describe the work and regulation of a barrister
What is general work for barristers?
-Once qualified barristers will work by practicing at the bar
-They are self employed so will work in chambers with other barristers. Some can work in businesses or for the CPS
-There will be a clerk who will do the admin work and book cases
What are the 7 general tasks of the barristers
-Rights of advocacy
-Present the clients case in court
-Question witnesses
-Complete legal paper work
-Give written advice to solicitors and clients
-Draft legal documents that will be used in court
-After 10 years as a qualified barrister they can apply to be Kings Council
What is Direct Access for Barristers?
-You can not approach a barrister directly to take your case for criminal and family cases
-You must go to a solicitor first, they will take on your case and approach a barrister upon your behalf
-In other civil cases the individual can approach the barrister without employing a solicitor first
What is the Cab Rank Rule?
-States that a barrister can’t turn down a case that is on an area of law they deal with
-They have to take the first case
-If an individual approaches them and not a solicitor then this rule doesn’t apply - they can turn case down
