Five Types fo Data Rights

A

Unlimited Rights: right to use, modify, reproduce, perform, display, release, or disclose technical data in any manner, and for any purpose whatsoever

Limited Rights: government may use the data within the government but not release the technical data outside of the government

Restricted Rights: government may only run the software on one computer at a time, may make only the minimum copies needed for backup, but may make modifications to the software. No release outside goverment

Government Purpose Rights: government and private funds are used in development effort; GPR expires after a time limit (the standard is five years); During the time government must limit the disclosure of the data outside of the government to government purposes

Specifically Negotiated License Rights: standard license arrangements are modified to the mutual agreement of the contractor and the government

Two standard DFARS clauses frequently used as part of the data management strategy

A

Deferred delivery: allows for the actual delivery of certain pre-determined CDRL items to be deferred until two years after the acceptance of all other items under the contract.

Deferred ordering: allows the government to order the delivery of any technical data or computer software generated under a contract until three years after the acceptance of all other items under the contract.
