what sentences does dangerousness test not need to be passed for?
- life sentence for second listed offence
- required life for manslaughter of emergency worker
- Required custodial sentence for certain offenders of particular concern
what does serious harm mean?
death
serious personal injury
what does specified offence mean?
- offence in s.306 SA 2020
- serious sexual, violent or terrorism offence
- offences in sch 18 which carry max sentence of 2 years or more
- offence carrying max sentence of life.
when is dangerousness assessment made?
at date of sentencing

what does significant mean?
more than a possibility. Must be ‘noteworthy, of considerable amount or importance’.
