what are the 3 types of sentence?
indeterminate+life sentences, determinate sentences, suspended sentence
describe what a life sentence is
judge imposed minimum time they must spend in prison before considered by the parole board to be released
what are the two types of life sentence?
-mandatory life sentences
-indeterminate sentences
what is an indeterminate sentence
there is a time set for them in prison but there is no automatic right to be released, some are IPPs(imprisonment for public protection)-detained indefinitely
what is a determinate sentence?
one with a fixed length but not all are served in prison e.g over 12 months 1/2 in prison,1/2 in community supervised by probation+conditions
what is a suspended sentence?
offender given sentence, but doesnt go straight to prison. can be suspended up to 2 years+must meet requirements, if not serve original sentence
does imprisonment meet the aim of retribution? give one strength+limitation
S: takes away freedom
L: difficult to say what length fits diff crimes, too short/long+what offences deserve prison

- high re-offending rates=not effective, 1/2 adults reoffend in 1 year

- short sentences-1/2=6months or less=not enough time to be dealing with long term problems which cause crime e.g mental health
- addresing offending behav: there is a shortae of places on courses like anger management, many indeterminate sentences remain in prison due to lack of programmes
When are community sentences given?
For crimes too serious for fines, not so serious for imprisonment

- supervision by probation officer
- up to 300 hours unpaid work
-residency requirements - treatments for e.g drugs includ. Testing

- all includ an element of punishment e.g exclusion orders restrict places+times-limits their freedom
- unpaid work-high visibility vest w/ community payback acts as ‘naming+shaming’ them
