15.2 Flashcards
As uknw , aus’s system of governemn is based on the federal parliamentary system. these governemts must:?
->protect the rights and freddoms of indidviduals
->make laws that reflect the views and values of the people
->be accountable to the people
->not abuse their power
governemts must protect tje rights and freedoms of individuals. how? and LIBERAL DEMOCRACY???!!
aus uses system goernment (liberal democracy) that aims to protect a range of basic human rights, freeedom and values that advance the wellbienf of indiviuals and place limits on the level of governemt control or interference
how does the government make laws the reflect the views and values of the people?
the system of governace in australia is based of the principle of representative governmnet, which means our commonwealth, state/territory parliaments consist memebers who are elected by the people to make laws on their behalf . those who fail to make laws the represtnt views, values and moral stantards of the mojority of voterd, they jeopardise their chance of being re-elected.
how must the government be accountable to the people?
The principle of responsible government. being accountable to the voters means that the governemtts must be able to justify their actions and decistions to the voters. this principle also ensures our governments are acountable by ststing that any memeber of the governments who acts in a dishounrable and irresponsible manner has a duty to resign from their position.thourghout many years many elected memebers of state and frderal governments have volunterrity resigned from their postions after being accused or porven to have acted dishonestly.
Governmets dont abuse their powers..? or do they?
So basically the pirincle of thsepartion of powers pis wht prevents our governments from abusing their power or making laws beyond their powers, by ensurinf that no single groups withini pur parliamentary system holds more than one of these three main powers.
in pracice the legislative and executive power are comibne, while the judiciary remains remains indepents. this indepenet court system allows the jugdes to resole disputes without any outside influnce from governmnet, party policies or voters, free from political bias (which means tehy are impartial when applying the law). this means the court can act as a check on parliament.
with the refence to the sepration of powers, ecplain why the jugdes may not be elected members of parliaments and sevre in the governemnt
Judges are not allowed to be in Parliament or the government because of something called separation of powers. This means that the government is split into three parts: the people who make the laws (Parliament), the people who carry out the laws (the government), and the people who decide if the laws are fair (judges).
If judges were in Parliament or the government, they might mix up their jobs, which could make it hard for them to be fair. They need to make decisions based only on the law, without worrying about politics. Keeping judges separate from the other parts of the government helps make sure they can do their job fairly and protect people’s rights.
But what are the main powers of governments?
->executive power- power to administer the law, held by th egovernmene. eg, governer-general, primeminister/senior, governments departments
->legislative power- power to make the law. eg. house of represestntaies and senate
->Jucidal power- power to apply the law. eg the high court and and other federeal courts
