Whats a hate crime?

Answer 1

An offence against person/s, motivated by a hatred of their actual perceived race, religion, ethnic/national origin, sex, gender, age, disability, sexual orientation, homeless or other status.

Note: Its the motivation, not the act itself

As police, what do we do when responding to a hate crime?

Answer 2

Record it on COPS (called a bias motivated crime)
Section 93Z of the crimes act (1900) says that its an offence to publicly incite hate based on gender, religion… but its difficult to make that stick, plus you need the Director of Public Prosecutions go ahead first.
Can be easier to charge under any other relevant offence.
