Who? Fuentes defaulted on a credit sales contract and her stove/stereo were repossessed by the sheriff through a prehearing seizure.
When?
Where?
What (did the court answer)? Whether Fuentes should have had a chance to be heard before the court before the items were repossessed/ Are the Florida and Pennsylvania replevin provisions applied in this case invalid under the due process clause of the Fourteenth Amendment?
YES! you need to serve before pre-seizure hearing, and ex parte seizure
Why (does it matter)? Court has an interest in not unfairly depriving people of life/liberty/property, procedure plays important role in fairness
(Also this was an example case to get us thinking about how rules have substantive implications with nuanced ambiguities to litigate and it gave us good practice picking out legal vocabulary, complex procedural quirks, procedural posture, etc. )
