Transfer of some work to outside ER’s payroll
Off-shoring - outside US
On-shoring - lower cost location inside same country
Near-shoring - location close by like Canada, Mexico
Unfair Labor Practices
Actions taken by ERs or unions illegal under NLRA, eg. refusing to negotiate in good faith, refusing to process a grievance, etc.
Pattern/Parallel Collective Bargaining
Union negotiates agmts similar to those existing in injustry/region
“whipsawing”

Objective criteria
Mandatory Collective Bargaining Subjects
Directly impact wages, hours, working conditions
MUST bargain if any proposal by either party
Agmt does not have to be reached, but process of bargaining in good faith must take place
Illegal Collective Bargaining Subjects
CANNOT be bargained over by either party b/c would violate law, even if parties agreed to enter agmt on it
Eg. closed shops, discriminatory hiring
Permissive Collective Bargaining Subjects
Not directly related to work, may agree to bargain but not required to, and may refuse w/o fear of unfair labor practice charge or strike.
Eg. benefits for retirees, settlements for ULPs, neutrality agmts
