A
- Importance of recovery orientated services & reduction of stigma
- important of a person orientated participation in community & life
- Right to respect
- A person is to be helped to achieve maximum quality of life
- A person is presumed to have capacity
- Aboriginal and Torres Strait Islander people should be treated in a way that recognises their culture

A
- You have (or reject) a particular belief
- You engage in promiscuous, immoral, indecent or illegal behaviour
- you have a particular sexual preference
- you have been previously treated for a mental illness

What are the steps to obtain a treatment authority (s 5 MHA)
A
Examination of a person (via examination authority –> recommendation for assessment –> assessment of person –> treatment authority

What are the criteria to be met for a Treatment Authority (MHA)
A
- The person has a mental illness
- The person does NOT have capacity to consent to be treated for the illness
- Because of their illness, the absence of treatment is likely to result in:
(a) imminent serious harm to the person or others OR
(b) the person suffering serious mental or physical deterioration

What are some rights given to patients under the MHA (2016)?
A
- Right to be given and have explained a Statement of Rights
- Right to be visited by support person/s
- Right to be visited by a health practitioner, legal advisor etc
- Right to be given oral explanations of treatment/care
- Right for support person/s to be given written notices
- Right to a second opinion
- Right to the appointment of an independent patients rights advisor
