Doctrine which states that if someone willingly places themselves in position where harm might result, knowing that some degrees of harm might result, they are not able to bring a claim against the other party
Volenti non fit iniuria
The degrees of prudence and caution required of an individual (nurse) who is under a duty of care towards another (client)
Standard of care
The principle that the mere occurence of some types of accident sufficient to imply negligence
Res ipsa loquitur
The illegal confinement of one individual against his or her will by another individual in such a manner as to violate the confined individual’s right ti be free from the restraint of movement
False imprisonment
The intentional act by one person that creates an apprehension in another of an imminent harmful or offensive contact
Assault
Threats, violence, constraints, or overt actions used to coerce someone into doing something against their will or better judgement
duress
Agreement as to opinion or a course of action
Consent
The facility to perceive, know, in advance, or reasonably anticipate that damage or injury will probably ensue from acts or omissions
Foreseeable
Failure of one person (nurse) to take reasonable care to avoid injury or loss upon another (client)
Negligence
To act otherwise than by their own free will or without adequate attention to the consequences
Undue influence
An act or event that breaks/severs the causal connection between a wrong committed by the defendant and subsequent happenings and therefore relieves the defendant from responsibility for these happenings
Assault
An intentional unpermitted act causing harmful or offensive contact with the “person” of another
Battery
An injured party’s failure to act prudently is considered to be a contributory factor in the injury that they have suffered
Contributory negligence
The tort doctrine that imposes responsibility upon one person for the failure of another, with whom the person has a special relationship.
