What is Intellectual Property?
Basically something that someone has invented or created, can be an abstract concept or idea, research, blueprints, lyrics or anything that hasn’t been done before.
What are four types/ways of protecting intellectual property?
Copyright
Trademarks
Design Rights
Patents
What does copyright protect?
Original works themselves, e.g. text, posters, papers, software, art, music, etc.
How is copyright infringed?
By copying the thing that is copyrighted
How long does copyright last?
The lifetime of the author, plus 70 years
What do trademarks protect?
Brands, logos, colours etc. which affect the image and reputation of a company
The symbol ® indicates what type of intellectual property?
Registered trademark
The symbol ™ indicates what type of intellectual property?
Unregistered trademark
The symbol © indicates what type of intellectual property?
Copyright
What is the duration of a trademark?
Indefinite
What do design rights protect?
Form and visual appearance of a design
Protects against piracy and counterfeiting
What is the duration of a design right?
Registered - 25 years
Unregistered - 10 years
What is a patent?
A registrable right to the exclusive use/manufacturing of an invention
How long do patents last?
20 years
What are the requirements for filing a patent?
Be new - never been disclosed to the public
Involve an inventive step - has to be something not done before/not immediately obvious
Be capable of having an industrial application
