What is a summons?
A summons orders a person to attend court, suspect not arrested.
What is a witness summons?
- be able to give different evidence
- produce a document or exhibit
- failure to attend can result in imprisonment / fine
How many months must a summons be directed to a person that committed a summary offence?
6 months
How must a service of summons be delivered?
- handing it to them personally
- leaving it at address
- positing it first class
What is a warrant?
A warrant is a written authority issued by a magistrate or judge
What are the the two different types of warrant and explain what they mean.
- Committal warrant - return to prison
- Arrest warrant - arrest for indictable offence, appear at court, answer bail, non-payment of a fine
What is section 26 of the Theft Act 1968?
may enter, search and seize anything believed to be stolen
What is a Section 8 PACE warrant?
May enter and search a premises provided there is reasonable ground to believe
- an indictable or either-way offence has been committed
- there is material which is likely to be evidence
