Little known useful powers
S50 Anti Social Behavioral Act
Request for name and address with arrest on failure to comply.
HORT1 Traffic Producer
Can request that a person submit required documents to the police station of their choosing.
Driving License, Insurance Docs, Proof of Ownership.
S59 Traffic Warnings
If someone is driving carelessly or inconsiderately, or is causing alarm, distress or annoyance you can:
- Stop the vehicle
- Power to seize and remove the vehicle.
- Can enter grounds where they believe the vehicle to be.
- Can use reasonable force to exercise the powers.
Community Protection Notice
Persistent ASB can be addressed with a CPN instructing them to cease the behaviour in 24hrs.
If they continue, get statements from impacted victims (residents, local businesses) - then can issue full CPN.
Breaching a CPN is an offence. Conditions need to be based on the initial complaints.
Uses include kids congregating around certain areas, drinking, taking drugs, intimidating people.
S99 RTA - Power to remove vehicles
Can remove vehicles that are:
- Parked on road in contravention of a statutory prohibition.
- Causing an obstruction
- Abandoned
- Broken down.
Driving Disqualification Order
Apply to courts to revoke a driver’s license based on criminality
S119 Criminal Justice and Immigration Act
Causing a nuisance or disturbance on NHS premises. Asked to leave by Police or NHS worker and refuses, remove.
Section 45/46 Serious Crime Act
Assisting or encouraging an offender
Byelaw 6
Can escort someone from the train or station using reasonable force.
S6 CLA - Violence to secure entry
Threatens violence to secure entry for themselves or others.
