PACE Section 1 (2)
Stop and Search
Any person or vehicle, vessel, aircraft, hovercraft.
Anything inside a vehicle or above conveyance.
Detain person or conveyance for purposes of a search.
PACE Section 1 (3)
Reasonable grounds to SUSPECT they will find stolen or prohibited articles.
PACE Section 1 (7)
Prohibited items to be located in stop and search are:
- Offensive Weapons
- Items used in Burglary,Theft, TWOC, Fraud and Criminal Damage.
- Fireworks

Use of Reasonable Force
A constable may use reasonable force when searching, arresting, taking samples and fingerprints - during execution of his duty.
PACE Section 17
Entry for Purpose of Arrest
Can enter when:
Executing a warrant of arrest.
Arresting a person for indictable offence.
Offences around squatting and unlawful eviction
Committing fear and provocation of violence
Driving under influence of drink/drugs
Failing to stop for constable in Uniform
Saving Life and Limb
Preventing serious damage to property. (Animals may be property)
PACE Section 18
Entry and Search After Arrest
Can enter and search a premises controlled by a person arrested in suspicion of an indictable offence.
Must be authorised by an Inspector or above.
PACE Section 24 Code G
Arrest Without Warrant
A constable can arrest someone:
About to commit a crime.
In the process of committing a crime.
Reasonable grounds to suspect they are about to commit a crime or are committing one.

Info on Arrest
State They are under arrest. The grounds for the arrest. The caution. The necessity.
PACE Section 31
Arrest for Further Offences
If a constable arrests someone and whilst they are in a police station and thinks that he would be liable to arrest for other offences if released, can further arrest for those additional offences.
PACE Section 19
Power of Seizure
A constable can seize evidence from a premises if he believes it is relevant to an offence committed or the purposes of preservation of that evidence.

Search Upon Arrest
Can search a suspect for:
Items used to escape custody
Evidence relating to an offence
Offensive weapons
If indictable offence can search premises they have been in immediately before arrest.
PACE Section 27
Fingerprints
A person can be required, 1 month after conviction, to attend a police station to have his prints taken.

Arrest (other persons)
A person other than constable can make an arrest for an indictable offence.

Necessity of Arrest
ID COP PLAN
- Investigate (prompt and effective)
- Disappearance (prevent them fleeing)
- Child (protect a child)
- Obstruction (obstruction of the highway)
- Physical Injury (prevent infection on self/others)
- Public Decency (prevent someone breaching)
- Loss or Damage (to personal/private property)
- Address (ascertain)
- Name (ascertain)
The Caution (when)
You do not have to say anything, but it may harm your defence if you do not mentioned when questioned something which you later rely on in court. Anything you do say may be given in evidence.
