Gathering information and intelligence regarding firearms enquiry.

A

STAY SAFE!

SEE - what is happening.
Subject - ID, description, behaviour, emotional, drunk/drugs, vulnerable (VP), mental illness, known to police?
Victim - public, police, where, why, time critical?
Location - accurate description, exact point, paint a picture for ITFC (initial tactical firearms commander)

TELL - communicate in as near real time as poss. Incident, weapons etc

ACT - stay safe, update, contain and observe.

Labelling firearms.

A

Unless trained don’t touch to firearms! Wait for AFOs.

Green label - it has been made safe. Can be transported without ballistic bag.

Red label - it was not been made safe by trained officer and MUST be transported in ballistic bag. Must be placed in secure storage and not handled (do not attached label to trigger guard)

Safety considerations when dealing with firearms.

A

Always treat the weapon as genuine not a an imitation. (Until can prove otherwise)
Always treat it was loaded.
Avoid touching the trigger or dropping the weapon.
Always lay the weapon flat on the ground.
Never point a weapon loaded or not as anyone.

A firearm under the firearms act 1968 means:-

A

A lethal barrelled weapon of any description.
From which any shot, bullet or other middle can be discharged and includes -
- any prohibited weapon (wether Latham barrelled or not.
- any component part or such lethal or prohibited weapon
- any accessory to such weapons which are designed or adapted to diminish the sound or flash caused by firing the weapon.

Definition of Air Weapon

A

Section 1 of the Air Weapons and Licensing Scotland Act 2015
An air weapon, that is to say, a. Air rifle, air gun or air pistol which does not fall within section 5(1) of the firearms act 1968 and
The component parts of an air weapon.
Any accessories to such a weapon designed or adapted to diminish the noise caused by discharging the weapon.

Rifles and Shotguns.

A

Rifle refers to “rifling“ in the barrel. A spiral groove cut into the metal that spins the bullet as it travels, stabilising it to improve accuracy.
Shotguns have a smooth barrel.
Has a barrel length not less than 24inch.
A barrel bore not not exceeding 2 inches in diameter.
Must not have a magazine capable of holding more than two cartridges.
2+2+2 = definition.

Premises Licence & Personal Licence.

A

Premises licence must be displayed at all times in an area where everyone can see it. Premises manager must only be the manager at ONE place and hold a valid personal licence too.

Personal licence is current for 10 years and refresher after 5years.
Personal licence holders must supervisor or authorise the sale of alcohol to other staff with minimum training of 2 hours.

Licensing operating plan must include.

A

A description of activities.
Proposed capacity (decided by fire service)
Who the premises manager is.
Layout of premises and where alcohol is displayed.
Times that alcohol is permitted
Alcohol to be sold for consumption on or off the premises or both.

Core licensing hours.

A

Licensed hours. The time specified in the operating plans and contained in the premises licence when alcohol can be sold on the premises.

On-sales hours. Hours of the sale of alcohol consumption on the premises.

Off-sale hours. The sale of alcohol to be consumed off the premises.

Section 63 licensing Scotland Act 2005

And exemptions

It is an offence, out with the licensed hours to
Sell alcohol on the premises.
Allow alcohol to be consumed on the premises.
Allow alcohol to be taken from the premises.

Exemptions.
15min grace period after hours / 30mins if with a meal.
Unopened alcohol bought on the premises before closing.
Taking a drink to your room in a hotel.
Can be sold to a fellow trader or a pub to a club.
Sold to another for supply on a premises occupied by Armed Forces.

Licensing Scotland Act 2005

Section 102, 103,105, 107, 108, 109

A

S102 it is an offence to sell alcohol to a child or young person.

S103 it is an offence for a reasonable person to allow alcohol to be sold to a child on any relevant premises.

S105 it is an offence for a child to purchase or attempt to purchase alcohol.

S107 is an offence for any responsible person to allow alcohol to be sold, supplied or served by a child.

S108(2) offence to be delivered by a child.
S108(3) (a) deliver to a child.
108(3) (b) who allows to be delivered to a child.

S109(1) offence to send a child to obtain alcohol.

It is an offence for a person to fail to take responsibility for the safety of their weapon.
To fail to report ASAP the loss or theft of their air weapon.

ASBO age and who can apply for them?

A

Minimum of 12 years old.
Adults can get ASBOs too.
Local authority and Registered social landlords can apply for to the sherif court.

Breaching an ASBO

A

If you commit a crime not related to the asbo it will be an aggravation. If a crime is committed relating to the asbo it will be a breach of the asbo.
