Symbolic Speech
making political statements through action
Protected Speech
protection of expression through verbal and written action
Defamatory Speech
speech that is meant to tarnish the rep of someone that is not proven in fact as true and is not protected by the first amendment
Selective Incorporation
the application of constitutional protections to state governments
Due Process
the process and proceedings that must be followed when trying a person in a court of law
Equal Protection
protection against discrimination based on race, gender, sexual orientation, religion, etc
Exclusionary Rule
evidence obtained without warrant cannot be used in court
Miranda Rule
requires police to read rights to those they are detaining at the time of detainment
Establishment Clause
prevents the gov from making any laws that support/promote specific religions
Free Exercise
protects the right to practice any religion
Prior Restraint
judicial prevention of sharing media that would cause significant harm or is not protected speech
Rights of the Accused
right to not self incriminate, right to a jury of peers, right to have a lawyer present in all questioning, right to protection from cruel and unusual punishment
