What is a dismissal?
A dismissal is when an employer removes an employee from their job.
Why were the Acts introduced?
The Unfair Dismissals Acts were introduced to prevent employees being dismissed from their roles for unfair reasons.
Ground for dismissal- Redundancy
The employer can dismiss an employee if a genuine redundancy situation exsists.

Ground for dismissal- Incompetence
The employee can be dismissed if they do not perform their roles to an appropriate standard.
Example of incompetence
Poor performance or failure to reach agreed targets.
Ground for dismissal- Qualifications
If the employee does not have the relevant qualifications for performing their role.
Example of Qualifications
Failing to pass proffesional accounting exams that would enable them to work as a qualified accountant.
Ground for dismissal- Employee Misconduct
Unacceptable behaviour of an employee in the workplace.
Example of Misconduct
Persistent lateness or absenteeism.

Ways in which the dismissal of employees are deemed to be unfair.

Redress for unfair dismissal
If an employee has been found unfairly dismissed they have a right to one of three options of redress.
- Reinstatement
The employee: Gets their old job back
- Is entitled to back pay from the date of dismissal
- Is entitled to any improvements in conditions of employment while they were dismissed.
