Human rights

A
  • There is no universal or legalistic definition of human rights The closest we have is the list of rights set out in various declarations and treaties
  • Broadly speaking, human rights are basic moral or legal entitlements that exist for all human beings, irrespective of any personal qualities or characteristics
  • It is aimed at identifying the fundamental prerequisites for each human being leading a minimally good life beyond mere survival
  • They attach to individuals who can invoke them, they are of high priority and compliance with them is mandatory rather than discretionary

  • International declarations are non-binding agreements that set out aspirations or intentions of countries or international organisations who are party to it

Universal Declaration of Human Rights (UDHR)

A
  • It was adopted in a 1948
  • It sets out guidelines, principles, and articles for Human Rights
  • It has thirty articles
  • It includes both negative freedoms, such as freedom from slavery, and positive freedoms, such as freedom of movement
  • It also includes civil and political rights, such as the right to freedom of speech
  • It also includes social, economic and cultural rights, such as the right to education

  • International treaties are legally binding agreements between countries or international organisations in which they undertake to follow the obligations set out in the agreement and implement them into domestic law
