Section 6 RTA 1988 Power to require specimen of breathe - 18 Points
A constable may require a specimen of breath from a person they have reasonable grounds to suspect is or has been:
- driving, attempting to drive or in charge
of a motor vehicle - on a road or other public place
- and has alcohol in their body
Hospital procedure requesting blood/urine from hospital patient - 8 points
You must get medical approval before requesting any specimens.
You may not arrest a person while they are still at a hospital
Prescribed Limits - 6 Points
BREATH – 35 microgrammes of alcohol per 100 millilitres of breath
BLOOD – 80 milligrammes of alcohol per 100 millilitres of blood
URINE – 107 milligrammes of alcohol per 100 millilitres of urine
Roadside drug tests - 7 Points
You can conduct a roadside drug test on the following occasions;
- Committed a moving traffic offence
- Suspicion of a drug
- Involved in Road Traffic Collision
Section 3 Careless/Inconsiderate driving - 14 Points
If a person drives a Mechanically Propelled Vehicle on a road or other public place without due care and attention or without reasonable consideration for other persons
using the road or place , he is guilty of an offence
The Fatal 5 - 7 Points
1) Drink / drug driving
2) Speeding
3) Not wearing a seatbelt
4) Using a mobile phone
5) Dangerous driving
