What is ADR?
Alternative dispute resolution
Methods of resolving civil disputes without using the court system. There are 4 ways in which a party can chose to settle their case outside of court.
What are the 4 methods of ADR?
Meditation
Arbitration
Negotiation
Conciliation
What is mediation?
A neutral party (third party) helps the parties to reach a compromise situation
What is arbitration?
A neutral third party member helps compromise (like meditation) however one party wins and one loses (gains awards)
What is arbitration used for?
Building contract disputes
Holiday contract disputes
Other business contracts
What is negotiation?
Trying to resolve a case by negotiation with them directly (do this all through the case)
What is conciliation?
Very similar to mediation, apart from they play an active role in the discussions (may give opinions)
What is a tribunal?
Forum that’s used instead of court, less formal and can’t go to court after
What chambers are there in the first tier tribunal?
Social entitlement chamber
Health, education and social care chamber
War pensions and armed forces compensation chamber
General regulatory chamber
Taxation chamber
Land, property and housing chamber
Asylum and immigration chamber
