Timing Rules (Part XVI)

Question 1

If an act must be performed before a motion or proceeding, then

Answer 1

the day of the motion or proceeding is not counted–only the day on which the act is performed is counted.

Question 2

If an act must be performed after an event or judgment, then

Answer 2

the day of the event or judgment is not counted.

Question 3

For service after 5:00 pm, a party may have

Answer 3

one additional day to respond.

Question 4

For service by mail, a party may have

Answer 4

three additional days to respond.

Question 5

If the last day to perform an act occurs on a weekend or legal holiday, then

Answer 5

a party has until the next day the courthouse is open.
