The Philippine Constitution Flashcards
The highest expression of law. It is the fundamental law of a nation or state. It is a written document that forms the fundamental rules and principles by which the government is managed.
It makes clear the rights of the individual and creates limits to government power.
Constitution
Purposes of a Constitution:
- Prescribes the state’s kind of government
- Creates the different departments and specifies their respective functions
- The source of sovereign powers by the establishment of principles
- Promotes public welfare and establishes the rights of people that are obligated to be protected
They are the assembled body that either:
- write the constitution,
- revise the existing one, or
- propose amendments
Constitutional Convention
They receive the drafted/amended constitution for ratification. The people will decide whether it is acceptable, and the results are considered and followed by the government.
Plebiscite
This occurs when the people vote upon a passed law, but the results may or may not be considered by the state.
Referendum
At least 7 Philippine Constitutions have been framed in history. They are:
- The Biak-na-Bato Republic Commission of 1897
- The Malolos Republic Constitutionof 1899
- The 1935 Constitution and the Commonwealth Government
- The Japanese Occupation and the Second Philippine Republic (1943 Constitution)
- The 1973 Constituion and the Marcos Dictatorship
- The Freedom Constituion of 1986
- The 1987 Constitution
