What power does the High court have with regards to the Constitution
The High Court can hear cases that arise as a result of the Constitution or relating to the interpretation of the Constitution. The High Court can interpret the wording of the constitution however, it cannot change the wording.
What is an example of the High Court overriding commonwealth legislation
Australian Capital Televison Vs. Commonwealth. The legislation that prevented parties from advertising during elections was deemed to be invalid as it overrode the implied right to political freedom of speech
How does the High Court act as a check on the Constitution
Through being able to interpret the constitution and federal legislation, the high court can apply the law in accordance with society and ensure that it is relevant additionally preventing commonwealth law from being too broad or specific.
