Adversarial
Who decides on primary legislation?
Parliament
What is secondary legislation?
Statutory instruments - created by ministers to make changes to law
What is Common Law?
A binding precedent that has never been written down
e.g. murder, manslaughter, kidnapping, false imprisonment, perverting the course of justice
What is case law?
Helps to establish the precise meaning of legislation by setting precedents for future use by a court with similar cicrcumstances.
What is the magistrates court?
Presided over by a district judge or three magistrates
Most motoring offences
Minor criminal damage
Drunk and disorderly
Have restricted sentencing powers
Max. sentencing is 6 months and / or an unlimited fine
What is the crown court?
Deals with the most serious offences
Triable by judge and jury
What is NACRO?
National Association for the Care and Resettlement of Offenders
