Where is robbery covered in law?
Theft Act 1968 Section 8
Define robbery under Theft Act 1968 Section 8.
A person is guilty of robbery if he steals, and immediately before or at the time of doing so, and in order to do so, he uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force.
Does the person being robbed have to feel fear?
No - it’s the intention to put a person in fear that makes the offence complete.
What is the first requirement for a robbery?
A theft.
What kind of offence is robbery?
Indictable only
What is the maximum sentence for robbery?
Life imprisonment.
Define force under Section 8 Theft Act 1968.
A small amount of force is fine - BUT, it must be voluntarily applied (intentionally or recklessly).
Force can be used on ANY PERSON.
