What is the cab rank rule?
You are obliged to accept instructions in a case which are specifically addressed to you.
When does the cab rank rule apply?
You are a self employed barrister
AND
You are instructed by a professional client
AND
The instructions are appropriate (taking into account your experience, seniority and field of practice).
When can you refuse instructions?
Public access Conflict of interest Your instructions ask you to break the rules You don't have enough time It would mean you have to work out of ordinary hours Your insurance isn't enough Out of your jurisdiction You haven't been offered a proper fee Professional client is a credit risk
If the rule applies, you must accept instructions regardless of what?
Identity of client
Nature of the case
Client paying privately or public funding
Any belief or opinion you have formed of client
What do you do if you have a conflict of interest between clients?
You can accept instructions as long as you have fully informed consent from your prospective client and you can act in their best interests.
