Terrorist
Anyone who uses unlawful force to achieve political goals
Issues with defining terrorism
It’s a nebulous concept, and also very broad and politicized. “One person’s terrorist is another person’s freedom fighter.”
Depends on perpetrators (state v non-state), their targets, and their goals
UNSC Resolution 1566
Declares terrorism to be criminal acts designed to provoke terror and influence a government into action (or inaction).
UNSC Resolution 1373
States should do whatever is in their power to prevent terrorism within their borders
Effective Control
Directing or enforcing perpetration of terrorist acts
Overall Control
State wields overall control over the group by equipping, financing, coordinating or helping to plan operations
(Sometimes critiqued for broadening the role of the state too much)
State responsibility via control
Conduct is considered a state action if it’s committed under the direction or control of a state
Obligation of due diligence
States are not to knowingly allow its territory to be used contrary to the rights of other states.
They are also to take all reasonable means to prevent and halt wrongful behavior
Aiding and Abetting
Links between states and terrorist organizations are strong enough to amount to effective control
Self defense
Only in response to an armed attack can the territorial integrity of a state be violated
Unable or unwilling doctrine
Will the state from which terrorist operate suppress them on behalf of the victim state?
If yes: victim state cannot use force
If no: use of force is lawful
