What are MEES?

What is the definition of sustainability?
- Brundtland report 1987
- Meeting the needs of the present without compromising the ability of future generations to meet their own needs.
What was the chage to the Rules of Conduct 2021 regarding sustainability?
- Rule 3 – provide good quality and diligent service
- When advising client encourage sustainable solutions that minimise harm and deliver balanced economic, solial and environmental benefits
What are the current MEES regulations?
All existing leases form 1st April 2023 must be an E
Are there any planned changes to MEES?
- Under consultation
- C by 2027 (properties below C have to make improvements and log another EPC by April 2027)
- B by 2030 (properties below B April 2030 have to make improvements and log another EPC by April 2030)
What is the tripple bottom line?
- Social, environmental and economic
- People, planet and profit
When is an EPC required?
- Must be commissioned within 7 days of marketing
- Newly built, sold or let for a term greater than 6 months (&less than 99 years)
- Sub-letting or assignment of lease
- When newly refurbished and heating, a/c or ventilation services are altered and/or the building is subject to Building Regulations for construction/changes
- From 1st April 2023 all existing leases on commercial buildings require an EPC
How long does an EPC last?
10 years unless the building is altered requiring building regs at which point a new EPC is requried
When is an EPC not required?
- No heating
- Listed buildings
- Religious buildings
- Temporary buildings
- Buildings due to be demolished/redeveloped
What are the exemptions for MEES?
- If a building does not need an EPC
- Industrial units with low energy demand (no heating/cooling)
- Where tenancy less than 6 months with no security of tenure
- Where the tenancy is more than 99 years
- 7-year payback period (3 quotes for works)
- Works proven to devalue the building by more than 5%
- Exemptions last for 5 years and are not transferable on sale
- Exemptions must be registered with local authority and renewed every 5 years.
What are the ramifications if a building is not MEES compliant?

- Policed by Local Authority
- If breach less than 3 months – up to greater of £5,000 or 10% RV with max £50,000
- If breach over 3 months – up to greater of £10,000 or 20% RV with max £150,000

- Rule of conduct 3 – Provide a high quality and diligent service including advising your client on sustainable solutions where most appropriate.
- Rule of conduct 5 – act in the public interest, take responsibility and act to prevent harm
- RICS Valuation – Global Standards 2021 VPGA8 – valuers should be aware of sustainability features and the implications these could have on property values short, medium and long term
- Advising clients to seek specialist advise when out of the surveyors area of competence
- Green leases
