What should the parties do once placed on the SCL?
Fill out the questionnaire in the attachment to the PD
When a matter first comes before the SCL judge, what are the first matters to be considered?
Whether a document management plan is necessary and whether or not ADR will take place.
What is the primary consideration with respect to expert evidence?
Whether or not it is appropriate for a joint expert to be appointed
What should the parties do if a review is approaching?
Confer at least 1 week out with respect to appropriate directions to be made by consent
What should you do before filing a request for a trial date?
Inform the judge: whether it’s necessary to join any other parties; whether there are any issues with the pleadings; if that party has considered making an offer to settle.
What directions should be considered before filing a request for a trial date?
Preparation of a trial bundle; list of documents to be relied upon at trial; evidence that can be admitted without objection; an exchange of schedules of objections; preparation of trial plan; order of witnesses and length of time required for cross examination.
What should you do 21 days out from a trial?
Contact SCL associate to discuss preparation of trial bundle; and, working copies of documents.
