Subject matter jurisiction
A
- Court’s power to hear the type of claim being brought;
- Fedearl question when well-pleaded complaint arising under Constitution, laws, or treaties of US;
- Diversity when complete diversity and AIC > $75k

Citizenship
A
- Domicile - residence + subjective intent to remain;
- Artificial person is principal place of business (nerve center) AND state organized/incorporated;
- Executors are citizens of decedent’s state;
- Partnership is domicile of every [general] partner.

A
- P can aggregate claims against single D or multiple if joint tortfeasors;
- Multiple Ps can aggregate to enforce undivided right

Supplemental jurisdiction
A
- Where court has original jurisdiction, may assert supplemental over
- Claims so related that they form the same case or controversy
- Arising out of same transaction or occurrence and
- Arise out of a common nucleus of operative fact.
- If based on and would destroy diversity, no supplemental jurisdiction;
- But impleader won’t destroy diversity
- Decline if CPOO – Complex, Predominating, Original J dismissed

A
- Federal court has SMJ;
- All Ds agree;
- No D is resident of the forum state in diversity case; and
- Within 30 days of earlier of service of summons or initial pleading.
