Joinder of parties - compulsory

A

19(a) - Required party if no complete relief or inconsistent obligations (order joinder unless indispensable);
19(b) - Indispensable if cannot be joined AND cannot proceed fairly without them (must dismiss).

  1. Compulsory joinder, first look to whether party is necessary;
  2. Necessary if no complete relief without party or
  3. Danger that absentee party will be harmed;
  4. Inconsistent judgement, or double liability
  5. If necessary, second look to whether indispensable – joinder will destroy diversity;
  6. If indispensable, court may dismiss or proceed without them, factors:
  7. Alternative forum, likelihood of prejudice, chance of inconsistent judgement.
