What does section 1 of PACE state in regards to stop and search?
A police constable may detain in order to search, any person, vehicle or anything which is in or on a vehicle, in any place to which the public have access if he or she has reasonable grounds for suspecting that stolen or prohibited articles will be found.
Can items be seized under section 1?
Yes as well as section 19
Can you conduct a voluntary search?
Not under any circumstances
Can you search for alcohol?
No, only PCSOs have that power
How can you determine that you have reasonable grounds for a search?
Consider whether you suspect that this person, at this time, at this place, will have what you are looking for.
What does SHACKS stand for?
Seen Heard Actions Conversation Knowledge Smell
In what locations can you conduct a stop & search?
In a public place, where public currently has access at that time.
Under what circumstances can you conduct a stop & search in a garden or yard?
a) reasonable grounds for believing the person does not reside there
b) Reasonable grounds for believing they are not there with the permission of the person who resides there

What is a section 60?
Criminal Justice and Public Order Act. Allows an entire location to be covered and allows anyone to be searched within that location - lasts 24 hours.
