What does section 18 cover?
Search
Section 18 (1)
- Entering a premises of an arrested person
- If he has reasonable grounds for suspecting that there is on the premises evidence relating to offence, other than items subject to legal privilege.
- Some other indictable offence which is connected with or similar to that offence.
- A written authority must be given by an officer of at least the rank of inspector prior to conducting of a section 18 (1) search.
Section 18 (5)
- Before taking a person to a police station without obtaining authorisation of an inspector if the presence of that person is necessary for an effective investigation.
- Arrested person must be present during the search
- Inspector authorises after the fact
What does section 19 cover?
Seizing
Section 19 (1-3)
- Constable may seize anything on the premises if reasonable grounds for believing that it has been obtained in consequence of the commission of an offence.
- Or that it is evidence in relation to an offence which he/she is investigating or any other offence
- May have entered premises after being invited in, don’t need to use a power of entry to seize if you just come across evidence
Section 19 (4)
Constable may require info stored in any electronic form and is accessible from the premises to be produced so that it can be taken away in a visible and legible form. E.g. CCTV
