SECTION 1 PACE 1984
A police constable may detain in order to search any person, vehicle or anything which is in or on a vehicle, in any place to which the public have access if he or she has REASONABLE GROUNDS for suspecting that stolen or prohibited articles will be found.
ANY PLACE
On payment or not, with right by virtue of expressed or implied permission or any other place where people have ready access. NOT A DWELLING!
PROHIBITED ARTICLES
Made or adapted for causing injury or intended for such use
Bladed/sharply pointed: S139 CRIMINAL JUSTICE ACT 1988 – without good reason or lawful authority
Made or adapted for use in course of burglary, theft, twoc or fraud or intended for that use
Fireworks regulation act 2004
Adult fireworks are prohibited to u18’s. Under 18s can only have snaps, sparklers and similar. Category 4 (unfinished) fireworks are prohibited to over 18 also
GROUNDS FOR SUSPICION
SHACKS
S = Seen – what have you seen (action and behaviour) H = Heard – what was heard (conversations, alarm…) A = Actions- What did you do and how did they react? Did this change the grounds? C = Conversation – What did you say and what did they say? Did this change the grounds? K = Knowledge – Recent intelligence, crime hotspot, witnesses, cctv? S = Smell – Anything to suggest drugs?
NOT GROUNDS
- Race, ethnicity…
- Previous convictions or known to police
- High crime area
- Furtive movements (needs a well-articulated clarification)
- Associates (even if there are grounds for searching one of the group does not mean there are grounds for the others)
- Weak/non-specific description
- Just because they look a certain way does not give grounds
