Why were sport and the law originally associated with each other?
Sport and legislation traditionally seen as separate however the number of deviant acts in sport increased. Also law is required due to increasing amounts of commercialisation
Why may performers need protection from the law?
- To protect from injuries obtained through the deviance of other players
- Protect against potential spectator violence
- Can be compensated for loss of earnings from inequality
- Protection from negligence of referees or coaches
Give 2 examples of sports performers who have required protection from the law
Monica Seles - stabbed in the back during tennis match
Vowles vs Evans in Rugby scrum - vowles paralysed and law suit against the ref
How is player violence dealt with?
- NGB’s reinforcing rules and laws
- Fines/bans
- Sometimes dealt with by prosecution
Give two examples of why spectators are prosecuted
- Pitch invasions
- Fans attacking players mid game
What is the Bosman ruling?
Introduced in 1995
- Gave footballers improved rights
- Existing club could not demand a transfer fee
- Free movement within the EU at end of contract
How are officials negligent (definition style)
Breaching the duty of care resulting in (foreseeable) harm.
Therefore when they don’t do everything possible, they may be deemed negligent
Give a sporting example of official negligence
- Referee in poor position may lead to injuries sustained in a scrum (vowles vs Evans)
What are the 5 examples officials being negligent? (SCRES)
- Injury caused due to failure to check the surface of the ground
- Injury caused by failure to check clothing
- Injury caused by not applying the rules properly
- Injury caused by failure to check equipment
- Failure to stop the game due to injury
What is a coaches duty of care?
Legal obligation to eliminate all potential dangers and risks so that players can participate in a safe environment
Give 6 responsibilities of a coach
- Providing first aid
- Maintain the right supervision numbers
- Collect medical information
- Risk assessment
- Adapt sessions to needs of performers
- DBS/safeguarding checks
How can we ensure that spectators act within the law?
- Games played at specific time imposed by police
- Racist individuals prosecuted
- All seater stadiums
- Use of CCTV
- Police liaison - share info about known individuals
- Bans and fines

There must be a duty of care.
