a product of human intellect with a commercial value that is manifested in something physical but not the physical thing itself
why is intellectual property so protected
the idea is more important than the physical thing it manifests in because once you have the idea you can make endless copies however its much harder to create the idea
what do intellectual property rights (ipr) protect
creative works
inventions
tangible assets of a business
eg copyright patents design rights trademarks
copyright law
stops people from copying ideas by protecting the expression of the idea but not the idea itself
patent law
protects new inventions giving the owner exclusive rights for up to 20 years so that large corporations can’t push out competition indefinitely
nda/law of confidence
protects ideas before they become copyrighted or patented
design right
protects original designs
trademark
a sign capable of graphically distinguishing goods and services
piracy
unfair trading of a persons creation
drm - digital rights management
restricts the usage of a medium
dea - digital economy act
increases max jail time for internet piracy to 10 years
why does drm and dea not stop piracy
doesn’t happen at a scale high enough for jail time
its a hassle doing digital rights management
why should we protect software
not protecting it reduces purchases and reduces the income for software producers
what are the two types of free software
open source; you can use the program however you want but you must give credit or use under the copyright terms
shareware; programs are free and if you like it you can choose to give the owner a reward
