How does the Becker labelling theory explain the social construction of criminality
-every society makes rules that govern our behavior and these rules are applied in different ways
Time in regards to social construction example
Homosexuality. In england and wales it was decriminalised in the Sexual Offences Act 1967. Later, the age of consent was lowered from 21 to 16. This is due to how attitudes change over time, and things that were deemed deviant back in those times are no longer considered deviant.
Place example
Cannabis is illegal in England , but their is campaigns and calls to decriminalize it. It is legal in some states in America however, and the law is enforced different depending on where you are. In Japan possession of cannabis can and you 5 years in prison
Culture example
Cultures view crime differently due to many different factors, one of them being changing religious beliefs that shape a culture. Homosexuality is banned in Nigera but legal in England.
What is the rule of law?
Everyone is subject to the rule of law which can determine what punishment they get based on these factors
-Age and Mental capacity (insanity, diminished responsibility)
