Tell me about diff sexual offences and some restrictions ( more depth to come later!)

  • lifetime anonymity under section 1 of the sexual offences act 1992 - now sexual offences act 2003
  • indictable only offences are - rape, assault by penetration, cause or inciting a child under 13 or a person who has a mental disorder impeding choice to engage in sexual activity, an attempt/conspiracy to commit either of these two offences, rest are either-way Offences. If victim is under 13 it is all rape.
  • anonymity ceases to apply if dead, court on the request of the defendant if satisfied that witnesses will come forward, public interest, victim/ alleged victim gives written consent must be over 16. Consent isn’t valid if it can be proved that sole one interfered with it.
  • editors code of practice clause 7 (children I’m sex cases) word incest can’t be used - could lead to identification
