What is the definition of rape?
Intentionally penetrates with a penis someone’s mouth, anus, or vagina without consent
What is the definition of assault by penetration?
Intentionally penetrates sexually with anything another persons anus or vagina without consent
What is the definition of sexual assault?
Intentionally sexually touches another person without consent and the suspect has intent for sexual gratification
Does sexual assault have to be skin to skin contact?
No it can be through clothing
Who can arrest for sexual offences?
Constables and members of the public
What is the definition of exposure?
Intentionally exposes genitals and intends that someone will see them and be caused alarm or distress
For exposure does someone have to be alarmed or distressed?
No as long as there is intent
What is the consent in relation to sexual offences?
The person agrees by choice and has freedom and capacity to make decision
What are the defences to consent?
Ignorance, mental state, violent, asleep, communication, drink, drugs
What is the definition of inciting a child?
Person over 18 intentionally caused a child to engage in a sexual act
What is the definition of outraging public decency?
An act which is capable of being seen by 2 or more people of a lewd/disgusting/obscene nature by behaving in an indecent manner
Where must public decency have taken place?
Real possibility that members of the public may witness it
For public decency what is an act?
Does not have to be a physical act of doing something, nor sexual, can include publications, signs or objects
