What are intimate samples?
Blood, semen, tissue fluid, urine, pubic hair, swab from orifice (other than mouth), dental impression
What DNA samples can be taken for recordable offences?
Head hair, sample from nail or under nail, swab from any part of the body which isn’t intimate, saliva, skin impression
Is there a power to require a person to attend the police station to have samples taken after being convicted of a recordable offence?
Yes, section 63A PACE
Can police take pictures of people in custody?
Yes, section 64A PACE
What search are fingerprints subjected too?
Speculative search
If the detainee is 17 years or over who is consent required from for fingerprints?
The person themselves
If the detainee is 14/15/16 years of age who is consent required from?
Parent/guardian of that person, and that person themselves
If detainee is under 14 years of age who is consent required from for photographs?
The parent/guardian
If someone is arrested more than once can the police take their DNA on every time they go to custody?
No, because DNA doesn’t change and isn’t needed to be taken again
What is bail?
Suspect being released from custody on promise to give themselves up at a specified time and date
What are the reasons to refuse jail?
JAILHOP - justice, appear, investigation, loss or damage, harm, offences, particulars.
What is unconditional bail?
Bail with no restrictions
What is conditional bail?
Bail with restrictions
If a constable believes that a person will not appear or a bail condition broken what can be done?
Arrest for breach of bail
What is a surety?
A person who agrees with the court or custody officer, that the person released from custody will attend when required and if they fail to appear will pay a pre-agreed sum of money
