Indirect harassment in which work setting is offensive, obscene, abusive, highly sexualized

Harassment must be unwelcome Based on gender Severe and pervasive Affect condition of employment Employer knows/should have known about environment
Managers’ Organizational Responsibility
Organization can be held responsible for conduct, even if it had no knowledge of the behavior and even it had an anti-harassment policy in place
Coworkers Organizational Responsibility
Only responsible if they knew or should have known
Nonemployees Organizational Responsibility
Only responsible if the organization has knowledge of the conduct and failed to take action

Guidlines for Sexual Harassment Prevention
Develop written policy that prohibits sexual harassment
Inform managers and employees of policy
Inform them of appropriate actions to take if harassed
Investigate complaints properly
Take appropriate action against offender
