What are the rules of law
- legality: state can’t act outside its powers
- legal certainty : laws must be clear and accessible
- equality : nobody is above the laws
What is legislation
Laws passed by Uk parliament, decided by House of Commons and lords then royal assent by monarch
Which court is in charge of criminal law
Crown court
Which court is in charge of civil law
High court
Differences between norms and laws
- norms are developed over time
- laws MUST be obeyed
- norm are enforced by community disaproval
What counts as criminal law
A person who commits a crime against the state
What counts as civil law
Private disputes
Who starts criminal cases and what is the outcome if found guilty
Crown prosecution service starts criminal cases and if found guilty it will go on persons record
Who starts civil cases and what’s the outcome if found guilty
Started by individual and if found guilty payment will be made
What are the sources of law
- Custom: rule/ behaviour which develops in community
- Common law: unwritten and developed from customs
- Statute: act of parliament
