what is division of power and how is it divided
they are the responsibilities of the parliament/ the government has the power to make laws about these areas. there are three divisions
exclusive- federal
concurrent - federal and state
residual- state
what does each division look after
exclusive looks after immigration, marriage, customs laws, income tax etc
concurrent - health & education (the federal government funds the state government to run these), roads
residual- curriculum, law and order (police and courts), surrogacy + adoption + IVF
who prevails if there is a conflict
the federal laws
what divisions are included in the separation of power
executive council - governor general, PM, commissioners/ directors (ENFORCERS)
legislative - federal parliaments (LAW MAKERS)
judicature - high court, supreme court, other courts (STATUE LAW INTERPRETERS)
Why is the separation of power important
it is crucial to keep the rules separated so the rule of each law is not violated. each one keeps a check and balance on the other. it is important because it helps the balance of power in the government. it is fundamental in reducing the possibility of tyranny.
