Offering to supply or administer means?

A

This provision prohibits the act of arousing another person interest in controlled drug or of tempting others to use them.

Prosecution must prove two elements -

The communicating of an offer to supply or administer. (Actus Reus)

An intention that the other person believes the offer to be genuine (Mens Rea)

CL - R v During - An offer is an intimation by the person charged to another that he is ready on request to supply tp that other drugs of a kind prohibited by the statute.
