Evidential Material Definition?
Means the evidence of the offence or any items tangible or intangible of relevance to the investigation of the offence.
Private Communication Definition?
Means a communication whether in oral or written form made under circumstances that may reasonably be taken to indicate that any party to the communication describes it to be confined to the parties to the communication but
DOES NOT INCLUDE
Communication of that kinds occurring in circumstances in which any party to the communication ought reasonable expect that the communication may be intercepted by some other person without having the expressed of implied consent of any party to do so
Interception Device definition?
Any electronic, mechanical, electromagnetic, optical or electric optical instrument apparatus, equipment or other device that is used or is capable of being used to intercept or record a private communication (Including telecommunication)
Does not include hearing aids or similar
Visual Surveillance Device Definition?
Means any electronic, mechanical, electromagnetic, optical or electro optical instrument, apparatus, equipment or other device that is used to is capable of being used to observe and record a private activity
Does not include spectacles or similar
Visual trespass surveillance definition?
Is not defined in the act but can be taken to mean, trespass surveillance involving the used of a visual surveillance device
List three types of Surveillance devices?
An interception device
A tracking device
A visual surveillance device
Tracking device definition?
Means a device that may be used to help ascertain, by electronic or other means either or both of the following
- the location of a thing or a person
- whether a thing has been opened, tampered with, or in some other way deal th with.
Does not include a vehicle or other means of transport such as boat or helicopter.
