Search for someone found with a knife

Physical procedure

  1. Spread your legs out and hold out your arms.
  2. Is there anything on the floor?
    • Check mouth and tongue
    • Put arm on shoulder and check fingers
    • Run hands methodically along arm -> shoulders -> head
    • Run hands around chest and waist (tell them to then put that hand on chest)
  3. Do same on other side (both hands on chest)
  4. Run hands along waistband and check down legs and between crotch
  5. Do same on other side
  6. If knife is found…arrest and continue search under s32 PACE.

“Do you have anything on you that I need to know about before we get started?”

  1. You are detained for the purposes of a search.
  2. The ground for this search are that I have intelligence that someone matching your description is in possession of a bladed article. Therefore the purpose of this search is to find this bladed article.
  3. I am therefore searching you under s1 of the Police and Criminal Evidence Act 1984.
  4. My name is DC Kieran Busby, here is my warrant card, I am attached to Crawley Police Station.
  5. You are entitled to a copy of this search.
  6. (FOUND KNIFE) You are under arrest for Possession of an article with blade in a public place, Criminal Justice Act 1988 section 139. You do not have to say anything, but it may harm your defence if you do not mentioned, when questioned, something which you later rely on in court anything you do say may be given in evidence.
  7. I am now going to continue this search under section 32 of the Police and Criminal Evidence Act 1984.

  2. The ground for this search are that I have intelligence that someone matching your description is in possession of a controlled drug. Therefore the purpose of this search is to find drugs on your person.
  3. I am therefore searching you under s23 of the Misuse of Drugs Act 1971.
  4. My name is DC Kieran Busby, here is my warrant card, I am attached to Crawley Police Station.
  5. You are entitled to a copy of this search.
  6. (FOUND DRUGS) You are being arrested for Possession of a controlled drug under s5 of the Misuse of Drugs Act 1971. You do not have to say anything, but it may harm your defence if you do not mentioned, when questioned, something which you later rely on in court anything you do say may be given in evidence.
  7. I am now going to continue this search under section 32 of the Police and Criminal Evidence Act 1984.

    • Put arm on shoulder and check fingers
    • Run hands methodically along arm -> shoulders -> head
    • Run hands around chest and waist (tell them to then put that hand on chest)
  3. Do same on other side (both hands on chest)
  4. Run hands along waistband and check down legs and between crotch
  5. Do same on other side
  6. Take shoes off for me, take socks off, check soles of feet (can put back on)
  7. Start from the top but with metal detector.
