Before conducting a search by consent, you MUST determine that search is for what?
- To prevent the commission of an offence
- To investigate whether an offence has been committed
- To protect life or property
- To prevent injury or harm
What to advise when conducting a consented search?
- The reason for the proposed search
- They may consent or refuse to the consent of the search
During a consented search and the person withdraws, what do you do?
STOP immediately UNLESS you can invoke a warrantless search power to continue.
What should you always do when you invoke a search?
Record your GROUNDS for requesting a search and make notes in your notebook.
Can consent be given to search a person under 14years?
NO (in any place, vehicle, or other place)
UNLESS - found driving with no passengers of or over 14 years of age without authority to consent to vehicles search.
Under S/S do you need to report the requirements of a consented search?
No.
