Four elements which characterize the law
- order in society
- obligation
- punishment
- legitimacy
La loi est essentiellement préoccupée par la question de l’ordre social et de l’ordre de la société.
Law is essentially concerned with the question of social order / order in society.
The law
Law is a set of formal rules for people to live together in a orderly society
Obligation
We are obliged to respect/obly/ abide by the law.
The coercitive power of the law
If we do not respect the law, we will be punished
Punishment
Different types of punishment / the nature of the punishment depends on the nature of the crime.
The range of punishment is large : a fine, a community service, home detention, a prison sentence, the death penalty
Payer une amende si on enfreint une règle civile, payer une compensation monétaire ou des dommages et intérêts.
To pay a fine if we break a civil law / to pay some money compensation or damages
Civil law
The system of law concerned with private relations and agreements between members of the community.
Aller en prison si on enfreint une loi pénale
To go to prison if we break a criminal law
Criminal law
The system of law concerned with the punishment of offenders.
Legitimacy
These punishments are imposed / enforced by the judicial power.
La loi est faite par le parlement
The laws are made / passed by Parliaments (law-making bodies)
